RENT IS DUE THE 1st DAY OF EACH RENTAL MONTH
1) Term: The Landlord rents to Tenant a storage space designated as "Unit" with approximate dimensions of 8’ x 20’, subject to the terms and conditions of this Agreement. The rental continues month-to-month until terminated or revised. The Unit is provided clean and undamaged unless otherwise noted in a signed addendum. The Landlord reserves the right to revise or cancel the Agreement with 30 days’ notice to the Tenant. No Tenant signature is required for revised terms to become effective.
2) Rental Responsibilities: The Tenant is responsible for all contents inside the Unit. The Landlord is not liable for theft or damage to the Tenant's items. The Tenant must purchase their own lock and ensure the Unit is secured. The Tenant is liable for any damages to the Unit while on-site, except for damages caused by the Landlord during drop-off or moving. The Tenant may not modify the Unit in any permanent way (e.g., cutting, drilling, welding). If unauthorized modifications occur, the Tenant is responsible for repair costs and must notify the Landlord immediately to assess the damage. Damage costs may be paid with the next month’s rent or at the termination of the rental. The Tenant is also responsible for damages caused by their agents, employees, invitees, and/or guests.
3) Moving the Unit: The Unit may only be moved if deemed necessary and feasible by the Landlord. Weight restrictions may apply, and the Landlord has the authority to inspect the contents before any movement. The Tenant must provide seven (7) days’ notice for moving the Unit, with confirmation via email or phone. The Landlord is not responsible for any damage to the Tenant’s belongings during transport; it is the Tenant’s responsibility to pack and secure their items properly.
4) Inspection: The Landlord may perform external inspections or preventative maintenance on the Unit with prior notice to the Tenant, provided by phone or email.
5) Payment: Monthly rent and other charges are due on the 1st of each month and will be charged to a pre-authorized credit card. The monthly rent is $[Amount], including New Brunswick sales tax. Rent for the first month is prorated from the date of agreement. No proration is provided for the last month. Rent must be paid in full each month; partial payments are not accepted. The Landlord reserves the right to adjust the rent with 30 days’ notice.
6) Termination by Tenant: The Tenant must provide at least seven (7) days’ notice before terminating the Agreement. The Tenant is responsible for all rent and charges until the Unit is vacated. Upon vacating, the Unit must be emptied, cleaned, and the Tenant’s lock removed. Failure to do so will result in the Tenant being charged for cleaning and emptying costs. Rent and fees continue to accrue until the lock is removed.
7) Default: If the Tenant fails to pay rent or fulfill any obligations under this Agreement, the Tenant will be in default. The Landlord may take legal action for restitution and may overlock the Unit if rent is more than seven (7) days overdue. If the Tenant does not settle the account within ten (10) days of receiving a default notice, the Tenant's property may be removed, advertised, and sold as per New Brunswick law. Prior to this, the Landlord will inventory the Unit’s contents for inclusion in the notice and advertisement. The Tenant’s lock will be replaced with the Landlord’s lock at this time.
8) Use of Storage Space: The Landlord is not in the business of storing goods for hire, and no bailment is created under this Agreement. The Landlord exercises no care, custody, or control over the Tenant’s stored property. The Unit is for storing property owned by the Tenant only. The Tenant agrees not to live in the Unit, use it for illegal purposes, or store flammables, stolen property, perishables, or anything alive or dead. The Landlord makes no admission of the value of stored property and accepts no liability.
9) Hazardous or Toxic Materials: Storing or using hazardous or toxic materials on the premises is strictly prohibited. The Tenant is liable for any costs, fines, or penalties resulting from the storage or use of such materials. The Landlord may enter the Unit at any time to remove and dispose of prohibited items.
10) Care of the Premises: The Tenant and their agents must maintain the premises in good condition, with reasonable wear and tear excepted. The Tenant shall not engage in any practices that could damage the property or create a nuisance. The Tenant is responsible for keeping the premises clean and free of debris and for the removal of rubbish at their expense. The Landlord is not responsible for rubbish removal.
11) Insurance: The Landlord does not provide insurance for stored goods. The Tenant is encouraged to obtain renters insurance to cover personal property and liability.
12) Release of Liability for Bodily Injury: The Landlord and their agents are not liable for injury or death to the Tenant or their agents, employees, invitees, or guests resulting from the use of the storage space, even if caused by the Landlord’s negligence.
13) Indemnification: The Tenant agrees to indemnify and hold harmless the Landlord from all claims arising from the Tenant’s use of the premises, except for claims resulting from the Landlord’s sole negligence.
14) Landlord’s Right to Enter: The Landlord and government authorities may access the Unit with one (1) day’s notice for non-emergency situations. In emergencies, or if illegal use or necessary repairs are suspected, access may be granted without notice to preserve the premises and ensure safety.
15) Severability: If any provision of this Agreement is deemed invalid, the Agreement will be amended to exclude the invalid provision, and the remainder of the Agreement will remain in full effect.
16) Governing Law: This Agreement is governed by the laws of the province of New Brunswick and the federal laws of Canada.
17) Entire Agreement: This document constitutes the entire Agreement between the parties and may only be modified in writing, signed by all parties.
